Terms of Service and Conditions

Welcome to Apex Tattoo, LLC. By booking an appointment, paying a deposit, or receiving any service from our artists, you, the client, agree to the following terms and conditions. These terms are designed to ensure a safe, professional, and respectful environment for everyone.

1. Deposit and Payment

1.1. Deposit Requirement: All appointments require a non-refundable, non-transferable deposit. This deposit secures your appointment date and time and compensates the artist for their time spent on consultations and drawing a custom design. The deposit amount is determined by the artist based on the size and complexity of the project.

1.2. Payment: The deposit will be applied to the final cost of the tattoo. The remaining balance is due upon completion of the tattoo session. We accept cash and major credit cards.

1.3. Forfeiture of Deposit: You will immediately forfeit your deposit for any of the following reasons: a. No-Show: Failing to appear for your scheduled appointment without proper notice. b. Late Arrival: Arriving more than 15 minutes late without prior communication. c. Improper Condition: Arriving under the influence of drugs or alcohol. d. Failure to Reschedule: Not providing at least 48 hours' notice to reschedule your appointment. e. Design Change: Requesting a completely new design concept after the initial consultation.

2. Rescheduling and Cancellation

2.1. Rescheduling: If you need to reschedule your appointment, you must notify the shop at least 48 hours in advance. Failure to do so will result in the forfeiture of your deposit. One reschedule is permitted per deposit. Additional rescheduling may require a new deposit.

2.2. Cancellation: All deposits are non-refundable. If you cancel your appointment, you will forfeit your deposit.

2.3. Artist's Right to Reschedule: The artist reserves the right to reschedule an appointment at any time, including but not limited to illness or personal emergencies. In such cases, your deposit will be transferred to the new appointment date.

3. Design and Artist's Discretion

3.1. Design Consultation: The client is responsible for providing clear and concise design ideas and reference materials during the initial consultation.

3.2. Design Approval: The final design will be presented on the day of your appointment. Minor adjustments may be made at that time. Major changes or a request for a new design concept will result in the forfeiture of your deposit and may require a new consultation and deposit.

3.3. Artistic Integrity: The artist retains full creative control and discretion over the final design to ensure its quality and longevity. The artist reserves the right to refuse to tattoo any design they deem inappropriate, offensive, or against their artistic style.

3.4. Artistic Property: The artist retains all rights to the custom artwork created for you. The client is paying for the application of the tattoo, not for the ownership of the design.

4. Client Responsibilities

4.1. Age Requirement: You must be at least 18 years of age to be tattooed. A valid, government-issued photo ID is required from all clients. No exceptions will be made, even with parental consent.

4.2. Medical Conditions: It is the client's responsibility to inform the artist of any and all medical conditions, allergies, or medications that may affect the tattooing process or healing. This includes but is not limited to: * Allergies to latex, metals, pigments, or soaps. * Skin conditions such as eczema, psoriasis, or keloid scarring. * Medical conditions such as diabetes, hemophilia, or any blood-thinning medication.

4.3. Preparation: You are responsible for arriving to your appointment well-rested, hydrated, and having eaten a full meal. You must also ensure the area to be tattooed is clean and properly moisturized.

4.4. Aftercare: The artist will provide detailed aftercare instructions. You are responsible for following these instructions to ensure proper healing. [Your Tattoo Shop Name] is not responsible for any issues resulting from a failure to follow aftercare instructions.

5. Release and Waiver of Liability

5.1. Acknowledgement of Risk: You acknowledge that you are voluntarily receiving a tattoo and are aware of the risks involved, including but not limited to: * Allergic reactions to pigments or products. * Infection, scarring, or nerve damage. * Pain, discomfort, swelling, and bleeding. * The permanency of the tattoo.

5.2. Waiver: You hereby release, waive, and forever discharge Apex Tattoo LLC., its artists, employees, and affiliates from any and all claims, liabilities, damages, or causes of action arising from the tattoo process.

5.3. Final Decision: By proceeding with the tattoo, you acknowledge that you have carefully read, understood, and agreed to all of the terms and conditions outlined in this document. You certify that you are of legal age and are voluntarily entering into this agreement.
